By downloading, accessing, or using the Chat Bot AI mobile application or website (https://chatgptai.app), a service offered by Mobile Cosmos LLC ("Company", "we", "us", or "our"), you agree to be bound by these Terms and Conditions of Service ("Terms"). These Terms govern all current and future features provided by Chat Bot AI (collectively, the "Service"). If you do not agree to these Terms, please discontinue use of the Service immediately.

1. Eligibility & Anonymous Device-Based Access

The Service is available to individuals who are at least 13 years of age (or the minimum legal age required in your jurisdiction). Minor users must have parental or legal guardian consent to use the Service.

You do not need to register with a name, email address, or password to use Chat Bot AI. Your profile is created automatically and anonymously based on your device identifier. Creating accounts or triggering requests via automated scripts, bots, emulators, or reverse-engineered API clients is strictly prohibited and will result in immediate termination.

2. Generative AI Disclaimers & Limitations

• No Professional Advice: Responses generated by Chat Bot AI are provided strictly for informational, educational, and productivity purposes. They do not constitute professional medical, legal, financial, tax, or psychological advice. Always consult a qualified professional before making decisions based on AI outputs.
• User Responsibility: You are solely responsible for evaluating the accuracy, completeness, and appropriateness of any AI-generated content before relying on, sharing, or publishing it.

3. Acceptable Use Policy & AI Content Moderation (UGC Compliance)

To ensure compliance with applicable laws as well as Apple App Store and Google Play Store policies, you agree not to use the Service (including text prompts, voice input, or image/document uploads) to generate, upload, or share content that:

• Contains child sexual abuse material (CSAM) or child sexual exploitation and abuse (CSAE);
• Contains explicit sexual content, non-consensual sexual content, or extreme graphic violence;
• Encourages suicide, self-harm, eating disorders, or physical violence against any person or group;
• Promotes hate speech, harassment, bullying, defamation, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin;
• Facilitates illegal acts, cyberattacks, malware creation, fraud, phishing, or unauthorized access to systems;
• Infringes upon third-party copyrights, trademarks, privacy rights, or intellectual property rights.

In-App Reporting & Enforcement: Chat Bot AI includes a built-in content reporting mechanism (the flag/report icon next to AI responses). If an AI response is offensive, inaccurate, or inappropriate, you may report it directly inside the app. Each AI transaction is assigned a non-content reference ID (ai_id) that enables our moderation system to investigate abuse reports and immediately ban violating device accounts without storing private conversation text.

4. Features: Multi-Thread Conversations, Voice & Attachments

• Local-Only Conversation History: Your chat threads and messages are stored locally on your device. We do not store the text of your questions or AI answers on our servers. If you uninstall the app or tap Clear All Conversations in Settings, your local chat history is permanently erased.
• Voice Input & Voice Output: You may use Speech-to-Text (microphone) to dictate prompts and Text-to-Speech to listen to AI responses.
• Photo & Document Attachments (Premium Only): Premium subscribers may attach images/photos and supported documents (such as PDF, TXT, CSV, JSON, MD, DOCX) up to the configured size limit for multi-modal AI analysis. Uploaded files are transmitted transiently to the AI model to answer your prompt and are never stored on our servers.

5. Free Tokens & "Share and Earn" Program

New users receive a complimentary initial balance of tokens to try the Service. Tokens are deducted based on the length of your prompt and the generated AI response.

You may earn bonus tokens by sharing your unique referral link with friends via the Share & Earn feature when a referred friend installs and opens the app for the first time. Any attempt to manipulate the referral system through self-referrals, device resets, emulators, or automated traffic will result in token forfeiture and account suspension.

6. Premium Subscriptions, Billing & Cancellation

Chat Bot AI offers optional auto-renewing Premium subscriptions that unlock higher-tier AI models, photo/document attachments, and expanded usage limits.

• Store Billing: All payments are processed directly by the Apple App Store (for iOS devices) or Google Play Store (for Android devices) through your respective store account.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle (e.g., weekly, monthly, or annually, depending on the plan selected) unless auto-renew is turned off at least 24 hours before the end of the current period.
• Managing & Canceling Subscriptions: You can manage or cancel your subscription at any time in your device's Apple ID Account Settings (iOS) or Google Play Store → Payments & Subscriptions (Android). Deleting the app or clearing app data does not automatically cancel an active store subscription.
• Restore Purchases: If you reinstall the app or switch devices on the same platform, you can restore your active subscription anytime by tapping Check Subscription / Restore Purchases in the app's Settings or Premium screen.
• Refunds: Because all transactions are processed by Apple or Google, refund requests are subject to the applicable refund policies of the Apple App Store or Google Play Store. You may also contact us at [email protected] for support.

7. Account & Data Deletion

You have full control over your data. At any time, you can go to Settings → Delete Account & Data inside the mobile app to permanently delete your anonymous user account, token records, and associated metadata from our servers, as well as erase all local conversation history on your device. 8. Disclaimer of Warranties & Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. While we strive for high availability, AI response speed and availability depend on third-party AI infrastructure and network conditions.

To the maximum extent permitted by applicable law, Mobile Cosmos LLC, its officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising out of your use of or inability to use the Service or reliance on any AI-generated output.

9. Modifications to the Service and Terms

We reserve the right to update, modify, or discontinue any part of the Service (including supported AI models, token parameters, or app features) and to revise these Terms from time to time. When we update these Terms, we will revise the "Last Updated" date at the top of this page. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

10. Governing Law & Contact Information

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any legal action or proceeding relating to these Terms shall be brought exclusively in the state or federal courts located in Wyoming.
